Terms of Use

These Terms of Use (“Terms”) govern your access to and use of justext (the iOS app and website at justext.space, together the “Service”).

The Service is provided by Konstantin Durnev (“Provider”, “we”, “us”). Contact: durn3v@gmail.com.

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility — age 13+

You must be at least 13 years old to use justext. The Service is not directed to children under 13. By using the Service, you confirm that you are 13 or older. If you are under 13, you must not use the Service.

If you are between 13 and the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf, where required by law.

2. The Service

justext is a text-focused social network. Features may include accounts, text posts and comments, typography styling, follows, likes, rooms or topics, notifications, reporting, and related tools. We may change, suspend, or discontinue features at any time.

3. Accounts

• You sign in with Apple (or other methods we may offer).
• You are responsible for activity under your account and for keeping access to your Apple ID secure.
• You must choose a username that does not impersonate others or violate these Terms.
• One person should not create accounts to evade bans or abuse limits.

4. Your content

You retain ownership of the text and other content you post. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content solely to operate, improve, promote, and provide the Service.

You represent that you have the rights to the content you post and that it does not violate law or these Terms.

You can delete content or your account through the app (subject to residual copies in backups or legal retention, as described in the Privacy Policy).

5. Acceptable use

You agree not to:

• Use the Service if you are under 13
• Post illegal content, or content that exploits, endangers, or sexualizes minors
• Harass, threaten, stalk, or incite violence against others
• Post hate speech, or content that promotes terrorism or violent extremism
• Share others’ private information without permission (doxxing)
• Spam, scam, phishing, or engage in deceptive practices
• Impersonate people or organizations in a misleading way
• Interfere with or disrupt the Service, including probing, scraping at abusive rates, reverse engineering except where allowed by law, or bypassing security or rate limits
• Use automated bots or scrapers without our prior written permission
• Violate applicable law

We may remove content, limit features, suspend, or terminate accounts that violate these Terms or that we reasonably believe harm users or the Service.

6. Reporting and moderation

Users may report content or accounts. We may review reports and take action we consider appropriate, but we do not promise to review every item or to take any particular action.

7. Intellectual property

The Service, including branding, design, software, and trademarks (including “justext”), is owned by the Provider or licensors. These Terms do not grant you rights to use our branding except as needed to use the Service.

8. Third-party services

The Service relies on Apple platforms (including Sign in with Apple, App Store, and push notifications). Your use of Apple services is also subject to Apple’s terms and policies. We are not responsible for third-party services we do not control.

9. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that content will always be available or accurate.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 50, IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases, the limits apply to the fullest extent permitted.

11. Indemnity

You agree to indemnify and hold harmless the Provider from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, limits of liability, and indemnity) will survive termination.

13. Changes to the Terms

We may update these Terms by posting a new version on this page and updating the “last updated” date. If changes are material, we may also provide additional notice (for example in the app). Continued use after the effective date constitutes acceptance, except where law requires otherwise.

14. Governing law

These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply and cannot be waived.
